Equipment Hire Terms and Conditions

Welcome! We want your experience with Perth Camera Hire to be great. Below is a user-friendly summary of our equipment hire terms and conditions. Please read these key points carefully before hiring our gear. If you have any questions, just ask – we’re here to help!

Booking & Accounts

  • Booking Online: All equipment hires are made through our website (perthcamerahire.com.au). To book equipment, add it to your cart and proceed through the online checkout.
  • Account Creation: You’ll need to create an account on our website during checkout. This helps us keep track of your orders and contact details. (It’s quick and easy – just provide a username, password, and your basic info.)
  • Agreement to Terms: By placing a booking, you confirm that you agree to these terms and conditions.

Hire Period & Fees

  • Hire Period: Your hire period starts when you pick up the equipment and ends when you must return it (as agreed in your booking).
  • No Weekend Charges: We do not charge for weekends. If your hire includes a Saturday or Sunday, you won’t pay rental fees for those days (for example, if you hire from Friday to Monday, you’ll only be charged for Friday and Monday).
  • Daily Hire Fees: Hire fees are calculated based on the number of chargeable days in your hire period (excluding weekends). All prices for equipment hire are listed on our website when you book.
  • GST: Prices include GST (Goods and Services Tax) where applicable, and any GST amount will be clearly shown at checkout or on your invoice.
  • Security Bond: For some hires, we may require a refundable security bond (deposit). If a bond is required, you’ll be informed during booking. The bond must be paid in full before you collect the equipment. We’ll refund the bond to you after you return the equipment in good condition (we may deduct costs for any damage, loss, or late return if applicable).

Payment

  • Payment Timing: Hire fees (and any bond or other charges) are typically paid when you make your booking on our website. We accept standard payment methods as shown at checkout.
  • Late Payment: If any payment is not received by the due date, we reserve the right to pause or cancel your hire. We may also charge interest on overdue amounts and recover any costs we incur in obtaining payment (for example, bank fees or debt collection costs).
  • No Refunds for Early Return: If you return equipment early, we generally do not offer a refund for unused days, unless required by law or agreed as part of a special promotion.

Pick-Up & Drop-Off

  • Location: All equipment is collected and returned at our premises: 5/146 Balcatta Road, Balcatta WA 6020. This is our designated pick-up and drop-off location.
  • Pick-Up: Please pick up the equipment at the agreed date and time. Bring a valid photo ID (such as your driver’s licence or passport) when you come to collect – we’ll need to verify your identity before handing over the gear.
  • Drop-Off: Return the equipment to the same location by the agreed return date and time. We’ll inspect the gear to ensure it’s all in order.
  • Late Returns: If you’re unable to return the equipment on time, contact us as soon as possible. Late returns may incur a Late Return Charge (a late fee) to cover the extended hire. This fee is to compensate us for the delay and is calculated as described on our website.
  • Weekend Timing: We don’t charge for weekend days, but note that our office might have limited hours on weekends. We will arrange pick-up and drop-off times with you in advance, including around weekends, to make sure it’s convenient.

Using the Equipment

  • Our Equipment, Our Property: The equipment remains the property of Perth Camera Hire at all times – you are borrowing it under a hire agreement (you’re not buying it). Please treat it with care and respect.
  • Proper Use: Use the equipment safely and for its intended purpose. Make sure you (and anyone you allow to use the gear) know how to operate it correctly. If you need instructions or guidance, feel free to ask us or refer to the provided manuals.
  • Care and Maintenance: While the gear is in your possession, you are responsible for keeping it safe and in good condition. Avoid exposing it to rain, dust, or other harmful conditions beyond normal use. Use protective covers or cases if provided.
  • No Tampering or Unauthorised Repairs: Do not attempt to modify, open, repair, or service the equipment yourself, and do not let anyone else (other than us) do so. Breaking security seals or tampering with the equipment is prohibited. If the equipment isn’t working properly, inform us immediately and we will assist or arrange repairs.
  • No Sub-Hire or Transfer: You must not lend, sublease, or hire out the equipment to anyone else. The hire agreement is with you only – you can’t transfer it to another person without our permission. Similarly, you must not sell or offer the equipment as security to any other party. Keep the equipment under your personal control at all times during the hire.
  • Loss, Damage, or Theft: If the equipment is damaged, lost, or stolen while in your care, you must contact us immediately. In the event of damage, do not attempt to fix it yourself – we will handle repairs or replacements. Depending on the situation, you may be responsible for the cost of repair or replacement (see Loss & Liability below). We may deduct such costs from your security bond or charge you separately if no bond was taken.
  • Insurance: We strongly recommend that you have appropriate insurance to cover the equipment while it’s in your possession (for example, travel insurance or a special hire insurance) for events like theft, loss, or accidental damage. Remember, if the equipment is lost, stolen, or severely damaged during your hire, you will be liable for its value or repair costs, so insurance can protect you from a large out-of-pocket expense.

Loss, Damage & Liability

  • Your Liability for Equipment: If you fail to return the equipment, or if it is returned in a damaged state (beyond normal wear and tear), you are responsible for the costs. This could include the cost of repairs or, in severe cases, the full replacement value of the equipment if it’s lost or cannot be repaired. We will inform you of any issues and the associated costs.
  • Injury or Property Damage: Please use the equipment responsibly. Perth Camera Hire is not liable for any injury, death, or property damage that may occur as a result of misuse or improper use of our equipment during your hire. For example, if a camera or lighting equipment is set up incorrectly and causes an injury or damage, you will be responsible. Always follow safety guidelines and use common sense when operating equipment.
  • Indemnity for Breach or Misuse: If you breach these terms or misuse the equipment, and as a result we suffer any loss or costs (for example, the cost of repairing damaged equipment, or legal fees due to a claim), you agree to cover those costs. In legal terms, you agree to indemnify us for any loss or damage we incur because of your breach of the agreement or your negligent use of the gear.
  • Limits on Our Liability: Except as required by law, we do not accept responsibility for indirect losses that you or your business might suffer due to renting our equipment. This includes things like lost opportunities, lost income, or other consequential damages. For instance, if the equipment malfunctions or is not available and this causes you inconvenience or loss of a job, we will not be liable for that lost opportunity or income (though of course, we will refund any hire fees for equipment that couldn’t be used due to a fault on our part).
  • Australian Consumer Law: Nothing in these terms is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law or other applicable consumer protection laws. You may have statutory rights (such as guarantees about the quality and fitness of our services) that cannot be excluded. We respect those rights. In the event that any part of these terms is found to unlawfully limit your consumer rights, that part will not apply – your consumer rights will prevail.

Termination of Hire

  • Our Right to Cancel: We reserve the right to cancel your hire and require the immediate return of the equipment if you seriously breach these terms. Serious breaches include (but aren’t limited to) not paying fees when due, causing deliberate damage to the equipment, or using the equipment in an illegal or dangerous manner. If we cancel the hire due to your breach, you must return the equipment to us immediately upon request (or allow us to collect it), and you may forfeit any hire fees and bond paid (to cover our losses).
  • Your Right to Cancel: If you need to cancel your booking or return the equipment early, please let us know as soon as possible. (Cancellation policies, including any applicable fees or refunds, may be outlined on our website or booking confirmation. Generally, we try to be flexible and may offer a refund or credit for unused hire days, except where non-refundable terms or minimum hire periods apply.)
  • Outstanding Obligations: Ending the hire (whether by cancellation, early return, or due to breach) does not absolve you or us of any obligations that arose during the hire period. For example, you will still need to pay any outstanding fees or cover any damage that occurred, and we will still need to refund any bond due back to you.

Changes to Terms

  • Updates: We may update or change these terms and conditions from time to time. Updated terms will be posted on our website perthcamerahire.com.au. We will do our best to notify you of significant changes (for example, via email or a notice on our site).
  • Acceptance of Changes: If you have an ongoing account with us or frequently hire equipment, please check our terms periodically. By continuing to use our services or hiring equipment after terms have been updated, you are agreeing to the new terms. (If you ever do not agree with a change, you can let us know and stop using our services, but any hires already in progress will still be governed by the terms that applied at the time of booking.)

Governing Law

  • Which Laws Apply: These terms and conditions are governed by the laws of Western Australia. If there is any dispute between us about the hire or these terms, it will be resolved under Western Australian law.
  • Where Disputes are Handled: You agree to submit to the non-exclusive jurisdiction of the courts in Western Australia. This simply means that if we need to resolve a dispute in court, Western Australia is the venue, and both of us agree to have the case heard in a WA court.
